{"id":1189,"date":"2014-07-09T12:57:06","date_gmt":"2014-07-09T20:57:06","guid":{"rendered":"https:\/\/ego-vero.net\/main\/?p=1189"},"modified":"2014-07-09T12:57:07","modified_gmt":"2014-07-09T20:57:07","slug":"just-great-epa-now-claims-authority-garnish-wages","status":"publish","type":"post","link":"https:\/\/ego-vero.net\/main\/just-great-epa-now-claims-authority-garnish-wages\/","title":{"rendered":"Just Great: The EPA Now Claims the Authority to Garnish Our Wages"},"content":{"rendered":"<div class=\"TweetButton_button\" style=\"float: right; margin-left: 10px;\"><a href=\"https:\/\/twitter.com\/share\" class=\"twitter-share-button\"  data-url=\"https:\/\/ego-vero.net\/main\/just-great-epa-now-claims-authority-garnish-wages\/\" data-text=\"Just Great: The EPA Now Claims the Authority to Garnish Our Wages\" data-lang=\"en\">Tweet<\/a><br \/>\n<script>!function(d,s,id){var js,fjs=d.getElementsByTagName(s)[0];if(!d.getElementById(id)){js=d.createElement(s);js.id=id;js.src=\"\/\/platform.twitter.com\/widgets.js\";fjs.parentNode.insertBefore(js,fjs);}}(document,\"script\",\"twitter-wjs\");<\/script><\/div>\n<p>This is just great: the EPA now claims the authority to garnish our wages. \u00a0That&#8217;s the Environmental Protection Agency. \u00a0Claiming authority to unilaterally &#8211; bypassing the courts &#8211; garnish our wages if we are deemed in violation of their rules. \u00a0And I guarantee you that they can find a rule you are in violation of if they wish.<\/p>\n<p>According to <a href=\"http:\/\/www.washingtontimes.com\/news\/2014\/jul\/8\/power-grab-epa-wants-to-garnish-wages-of-polluters\/\" target=\"_blank\">this article in the Washington Times<\/a> the Agency has adopted a rule stating it&#8217;s intention to use the authority, a neccessary step before legally asserting the authority. \u00a0The garnishment threat would be a powerful tool to get people to agree to expensive settlements with the EPA rather than fighting them.<\/p>\n<p><a href=\"https:\/\/ego-vero.net\/main\/just-great-epa-now-claims-authority-garnish-wages\/stop_breathing_epa_thumb1\/\" rel=\"attachment wp-att-1190\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-1190\" src=\"https:\/\/ego-vero.net\/main\/wp-content\/uploads\/2014\/07\/stop_breathing_epa_thumb1.jpg\" alt=\"stop_breathing_epa_thumb1\" width=\"513\" height=\"411\" srcset=\"https:\/\/ego-vero.net\/main\/wp-content\/uploads\/2014\/07\/stop_breathing_epa_thumb1.jpg 513w, https:\/\/ego-vero.net\/main\/wp-content\/uploads\/2014\/07\/stop_breathing_epa_thumb1-150x120.jpg 150w, https:\/\/ego-vero.net\/main\/wp-content\/uploads\/2014\/07\/stop_breathing_epa_thumb1-300x240.jpg 300w\" sizes=\"auto, (max-width: 513px) 100vw, 513px\" \/><\/a><\/p>\n<p>This dovetails with a post I was going to write about Administrative Law and\/or The Administrative State and how it is at odds with our Representative Republic system of government. \u00a0In a nutshell, the Administrative State is a power grab by the executive branch. \u00a0&#8220;Administrations&#8221; or &#8220;Agencies&#8221; such as the EPA, the IRS, FEMA etc etc fall under the executive branch of the Fedral Government. \u00a0These agencies are allowed to make &#8220;rules&#8221; which carry the force of law, but often carry none of the due process protections associated with actual legislation. \u00a0Hence, the IRS can seize your property without a court order and now the EPA wants this power, too. \u00a0The argument against Adminstrative Law is that if these &#8220;rules&#8221; carry the force of legislation, then they are in fact legislation. \u00a0And legislating is not one of the enumerated powers granted to the executive branch under the Constitution &#8211; Congress is the only branch that has that power. \u00a0I can&#8217;t do the argument justice, so I direct you to some excellent posts at <a href=\"http:\/\/www.powerlineblog.com\/archives\/category\/administrative-state\" target=\"_blank\">PowerLine<\/a>.<\/p>\n<p>Why do you care or why should you care?
